Welcome to Bicycle World’s Pickup & Delivery Service. The term “Bicycle World”, or “us” or “we” refers to The Bike Route Company d/b/a Bicycle World, the owner of this website. The term “you” refers to the user of Bicycle World’s Pickup & Delivery Service. The use of Bicycle World’s Pickup & Delivery Service indicates your agreement to be bound by the terms and conditions listed below.

Delivery Schedule:

Once you have completed the online questionnaire, you will be contacted by a member of Bicycle World’s staff to discuss the timing of the pickup of your bicycle. Unless Bicycle World otherwise agrees in its sole discretion, pick-ups and deliveries will occur Tuesday through Saturday only. Bicycle World’s Pickup & Delivery Service will not take place on Sunday, Monday and selected holidays. Bicycle World reserves the right to determine the pick-up and delivery times in its own discretion and reserves the right to reschedule such times upon prior notice to you. Please check this website regularly for any changes to our normal Pickup & Delivery Service.

Pick Up and Delivery, Procedure and Terms:

When you are contacted by a member of Bicycle World’s staff to arrange a pick-up, you will need to indicate where your bicycle will be placed for pick-up (and where it should be returned for delivery) and you will also need to provide the combination for any lock or indicate where any keys for locks may be found. It is your responsibility to accurately describe the location of your bicycle and any keys as well as, if applicable, the location of, and the combination to, any locks. Bicycle World’s Pickup & Delivery Service will make every effort to locate your bicycle and to remove any locks, however Bicycle World’s Pickup & Delivery Service assumes no responsibility if it is unable to locate a bicycle or remove a lock during a scheduled pick-up or affix a lock during a scheduled delivery. Bicycle World’s Pickup & Delivery Service will attempt to contact you once by telephone at the number you provide if it is unable to locate your bicycle or remove any locks when it arrives for pick-up or if it is unable to locate or use any locks when it attempts to deliver your bicycle following repair. Given the number of customers Bicycle World’s Pickup & Delivery Service serves, Bicycle World’s Pickup & Delivery Service cannot wait at your location if your bicycle cannot be located or unlocked, in connection with a pick-up, or locked, in connection with a delivery, should you not be readily reachable by telephone. If Bicycle World’s Pickup & Delivery Service is unable to retrieve your bicycle, it will attempt to contact you by telephone to reschedule. If you have an answering machine or voice-mail, a message will be left. If you do not have an answering machine or voice-mail, Bicycle World’s Pickup & Delivery Service will attempt to call you two times. If Bicycle World’s Pickup & Delivery Service is unable to cause any locks to function in connection with a delivery, Bicycle World’s Pickup & Delivery Service will not leave your bicycle unless you have expressly authorized an unsecured delivery. In all other events, your bicycle will be returned to Bicycle World and stored until you are able to be contacted. Unless otherwise agreed by Bicycle World in its sole discretion, any bicycle not retrieved (or with respect to which service fees are not paid) within 90 days of service will become the property of Bicycle World and may be disposed of in such manner as Bicycle World determines, in its sole discretion. The proceeds of any such disposition shall also be the property of Bicycle World. Bicycle World’s Pickup & Delivery Service recommends that you remove all bags and accessories not permanently attached to your bicycle prior to pick-up, as Bicycle World cannot be, and is not, responsible for any damage when your bicycle is placed onto the racks utilized by Bicycle World’s Pickup & Delivery Service. Bicycle World cannot be, and is not, responsible for any damage or theft that may occur to any items left inside of any accessories (such as, for example only, watches, heart rate monitors, GPS tracking devices, etc.).

Loss or Theft in Connection with Delivery or Pickup:

Bicycle World’s Pickup & Delivery Service recommends that you lock or otherwise secure your bicycle at your location for pick-up and that you provide a lock to be used at your location when your bicycle is delivered. You are responsible for determining the method of securing your bicycle and Bicycle World’s Pickup & Delivery Service is not responsible for and shall not pay for, any loss, damage or theft of items at your location, whether secured or not.

Payment:

Unless otherwise agreed by Bicycle World, in its sole discretion, you must pay for all charges prior to delivery of your bicycle back to you. All bicycles shall be impressed with a workman’s lien in favor of Bicycle World until such time as all fees for services have been paid.

Scope of Service:

The work to be performed by Bicycle World will be reviewed with you by telephone at the time of scheduling a pick-up and after your bicycle has been evaluated by our mechanics. You will be provided with an estimate of the costs for service and work will not commence until you authorize the work to be performed either by telephone, fax or by electronic mail communication. An estimate of cost is not a guarantee. If you have strict financial restrictions in connection with the work to be performed on your bicycle, it is your responsibility clearly to indicate those restrictions to our staff when you speak to them.

Damages:

Bicycle World’s Pickup & Delivery Service will use reasonable efforts to try to ensure that your bicycle is safely transported to and from Bicycle World’s repair facility. At the time of pick-up, Bicycle World’s Pickup & Delivery Service will physically inspect your bicycle for any existing cosmetic or other damage and may record any such damage or take photos of the same, at its discretion. Any photos taken are and shall remain the sole property of Bicycle World. Bicycle World agrees that such photos will only be used in connection with documenting the condition of your bicycle and not for any other commercial purpose.

Disclaimer:

Bicycle World’s Pickup & Delivery Service’s liability under this agreement shall be limited to general money damages in an amount not to exceed the present fair market value of your bicycle. This liability shall be the extent of Bicycle World’s liability regardless of the form in which any legal or equitable action may be brought and the foregoing shall constitute your exclusive remedy. In no event will Bicycle World be held liable or be responsible for any consequential, special, indirect, incidental, or punitive loss or damages whether or not Bicycle World knew or should have know of the likelihood of any loss or damages. Bicycle World disclaims all warranties, express or implied, with respect to the services rendered under this agreement.

Entire Agreement/Choice of Law:

This agreement constitutes the complete, exclusive, and entire agreement between the parties, may not be modified except in writing signed by both parties, and shall be governed by the laws of the State of New York.
